No one is asking for "extra and special" rights, they just want to be extended the same rights as heterosexuals. There is no traditional "legal definition" of marrige in US law, just ad hoc definitions that have recently shoehorned into law with the sole and express intent of denying the right to marry to homosexuals. Not because it reflected any traditional legal definition, but because conservative and religious reactionaries don't like gays and would rather see them back in the closet, or better yet just eliminated altogether.
Futher more, in Califonria a ban on gay marriage was ruled to be unconstitutional under the California state constitution, Prop. 8 didn't not change the constitution, it simply reinstituted a ban that was previously ruled to be unconstitutional. If you want to outlaw gay marriage then you need more than a ballot initiative, you need a constitutional convention.
