Fundies get more desperate every day, now they are beginning to realise that America was not based on any religion, they now saying the constitution is more flawed than the bible.
Tough, you are an American citizen pledged to follow the laws of your land, and if that is in conflict with your belief, you are free to leave and take your extremely flawed bible with you.
Yes, the Constitution, and pretty much any laws in general, has their flaws. But it's because we have different opinions about what's moral. However, if we need to, we can change the laws and such to make things more fair for everybody.
You know, if you look at it this way, laws are flexible, and, in a way, can evolve and adapt to make things fair. But the Bible is ridged and rather out of date.
That's kind of the point of Christianity, isn't it? No one can live up to god's standards, that's why god sent Jesus. Asking why god arranged reality this way will only get you damned. Historically, the priests of Jesus have been more than willing to help the overly curious on their way.
As a document of human law, the American constitution is far superior to the bible. The authors of the constitution recognized its imperfections and included a procedures for amending it. Since the bible was not designed to be amended, the only way to deal with dissent is by murdering the dissenters.
Any attempt to have a Biblical (church ran) society has always been an attempted ditatorship

The Constitution provides for a system of checks and balances, to prevent a tyrannical state, despite whate you may hear from paranoid wingnuts. Although tough to do so, flaws in the Constitution may be amended. Flaws in the Bible (homophobia, allowance for genocide, flat earth, etc.) may not. EVER!
