He got all three of his points wrong. Actually, the Second Amendment is the right to bear arms; the Fourth is unreasonable search and seizure.
As for the Fifth Amendment: so? That's why there's a Supreme Court to declare laws unconstitutional if they are. (precedent of Marbury v. Madison )
Finally, the Eighth Amendment is cruel and unusual punishment. It certainly does apply. (The Sixth is fair and speedy trial.)

Though I seriously doubt his supposed "credentials" there, a lot of people can say "I majored in this at University, it's my job, but I don't know a damned thing about it"
Also, yes, the first ten Amendments are known as the bill of rights. As amendments, they are considered part and parcel of the constitution.

If you read the thread further, Richard says he's a freshman(a far cry from majoring in the Constitution and being a Constitutional scholar, especially since I've never even HEARD of a degree in the Contstitution), he also says he referenced a page that had them OUT OF ORDER.

Right to bear arms is the second amendment, unreasonable search and seizure is the fourth (and it doesn't matter what the law says if the Constitution says it's not allowed, because then the law is unconstitutional and unenforceable), and the right to a fair and speedy trial is amendment #6. Your knowledge of the Constitution is at right angles to reality.
I knew the Bill of Rights in my junior year of high school (alright, only kinda-sorta). It really pisses me off, though, when people try and sum up amendments in a few words, especially the 1st. It's not ONLY freedom of speech, but also religious expression, peaceful assembly, petition, and press.
So, you´re scholar and don´t understand that torture IS illegal, and that privacy is a right that ONLY can be broken by judicial command if THERE ARE PROOVES. And the fair and speed trial, where does apply, according to you?. NO NO NO.
